I oppose the proposed development based on the following breach of Marrickville Local Environmental Plan 2011 (MLEP) and Marrickville Development Control Plan 2011 (MDCP) planning controls in relation to the building height of the proposed development.
The proposed development breaches the 20m maximum height of building planning limit under the MLEP. Structural features exceeding the maximum building height limit include the roof top parapet, open access stair area and lift housing within the roof top terrace area. These areas would be clearly evident to, and overshadow neighbouring unit blocks, residential allotments and commercial properties. Therefore, the development negatively impacts the privacy, solar access and amenity of neighbouring properties which have been constructed to adhere to the MLEP building height limits. In addition, the MDCP 2011 Marrickville Town Centre (Commercial Precinct 40) document states that the ‘Desired Future Character’ for this area is “to ensure new development at rear upper levels is a maximum of five (5) storeys” (section 9.40.2 – pt.6). The proposed development exceeds this limit at six (6) storeys high.
The new residential blocks along this section of Illawarra Road are continually being approved; dispute exceeding MLEP and MDCP planning controls. Why bother having planning specifications if council keeps allowing developers to operate outside them with no regard to how the new developments will impact existing adjacent structures and residents?
In addition, I am concerned regarding the potential impact of the proposed development to public amenity; specifically with regarding to access and safety for private vehicles, and pedestrians who use Frede Lane and Stinson Lane to access Marrickville Station.
The increased heavy-vehicle construction traffic for the duration works impedes both pedestrian and vehicular access in these narrow laneways, and is also potentially dangerous to pedestrians. The current construction site at 415-417 Illawarra Road has already impacted the laneways; as they have been inaccessible and/or unsafe to access at times due to the delivery of large loads of construction materials.
Furthermore, the road pavement of both Frede Lane and Stinson Lane has been substantially degraded due to the heavy vehicle traffic; these two laneways are now full of potholes and tension cracks due to the excessive vehicle weight loads placed on these small access roads.
Why is council not making the developers use Illawarra Road for deliveries, and why is council also making developers accountable for the repair of these laneways post-construction?
