    A fence erected on new soil height above the retaining wall will reduce solar access when it is adjacent to the windows of neighbouring bdwelkings and should face rigorous scrutiny.

    As a condition of consent the applicant should be directed to deduct retaining wall height from current and future fence height where that portion of fence erected above the retaining wall in order to maintain solar access to the adjacent residents.

    A flood study and engineers certificate be obtained by the applicant and produced to the consent authority and there be no unacceptable increase in flood risk or diversion of natural watercourse.
