    Remove one (1) Phoenix palm from the centre of rear property boundary. At the time of inspection, the palm in question was assessed to be in fair health and growing into the canopy of a Brushbox. The palm is in an unsustainable location, its removal will provide the Brushbox’s canopy more sunlight and unimpeded space to thicken and mature. As there is insufficient green space to accommodate one (1) mature tree of similar dimensions, the replacement tree condition is to be satisfied with one (1) Offset Tree Planting Payment.

    Remove one (1) Avocado tree from rear side boundary. At the time of inspection, it was assessed at the Avocado tree had germinated most likely from a bird dropping and was growing around an existing Eucalypt which its trunk has fused to. Both trees were impacting the boundary fence which can only be repaired with the trees’ removal. Both trees have insufficient space to mature with vigour, they are both in an unsuitable and unsustainable location. As there is insufficient green space to accommodate one (1) mature tree of similar dimensions, the replacement tree condition is to be satisfied with one (1) Offset Tree Planting Payment.

    Remove one (1) Hills Weeping Fig from rear of property. This tree is only small and has most likely escaped from a pot, however, it is now growing in the ground with the potential to reach massive proportions, damaging both the applicant’s and neighbouring properties. It is in an unsuitable and unsustainable location and has insufficient space to mature in good health with vigour. As there is insufficient greenspace on the property to accommodate one mature replacement tree, the replacement tree requirement is to be satisfied in a one-off Offset Tree Planting payment.

    Remove one (1) Cook Pine from rear left boundary and replace with two (2) trees growing to similar dimensions at maturity from Council’s Preferred Tree list, of minimum 45L pot size, anywhere on the property within one (1) month of removal. At the time of inspection, the tree was assessed to be a healthy specimen, with no obvious signs of pest or disease presence or structural defects. It should be noted that a this is a Request for a Review of Determination - since the original determination under TPO-274/2021, documented excavation was undertaken and evidence was provided to Council which showed the tree’s roots to be the primary cause of the plumbing issues at the property and the adjoining property at 23 Hastings Parade. A plumber’s report has also been provided which stated ‘the boundary trap has been dislodged, cracked, and requires immediate replacement due to large tree roots penetrating and dislodging pipe work from 21 Hastings Parade.’ The repairs to the boundary trap can only be conducted with the tree’s removal.
