To Whom it may concern,

My name is Jobie Lebler and I am a resident at 74 Constitution Rd in Dulwich Hill. I live at this address with my wife and my two sons aged 5 and 9 and we have lived here for 10 years. I would like to strenuously object to the proposed DA at the Arlington Grove development on the following grounds:

The proposed request is in the heart of a residential area and the proposal ( in particular the extended trading hours and licence to sell alcohol request ) are completely out of keeping with the area and the local residential community.
The scale of the proposal is ( 160 patrons ) is far too large for the site and not supported with adequate facilities such as parking, toilets etc. The DA states there is ample parking however this is certainly not the case as any local residents can attest to.
The impact of traffic to the local streets will be significant especially from visitors and staff parking and deliveries. The impacts to residents will be further exacerbated by the proposed early opening and late closing times of the site.
Public Transport. Closing hours will be after the Light rail service has finished and staff and late customers will need vehicles to return home
The proposed changes will seriously impact on residents though noise and loss of privacy and loss of amenity.
The site has insufficient toilets to support a proposal of this scale particularly if the licence to serve alcohol is approved. Additional toilets are located in the basement and would compromise the security of the basement.
Our Community is already over supplied with Cafes and bars. The DA mentions Sideways cafe as over flowing but fails to mention the near by cafe's in The Denison and on New Canterbury Rd which are far from over flowing
There is an additional risk due to the ongoing development in the surrounding buildings. I believe this may present a real danger with people placed at risk with the construction works underway and continuing for some time

In summary I strongly object to the proposed DA and request that Council take the appropriate steps to protect residents rights and put a stop to the developers ambit claim that if approved would place unsustainable impact on local residents ( including those who have recently purchased in the Arlington Grove development and other developments surrounding the site ).

This suburb is a dormitory suburb.

The residents living in these small concrete boxes need to sleep.

The serving of alcohol to drunkards should not be allowed after 10pm.

To whom it may concern,

I am a future owner-occupier of the KONA building as part of the Arlington Grove Development. My residences is located directly above the allocated retail space in the development plan on level 2. I have no objection to this retail space being used as it was clearly outlined as a retail space in the original plans, however I take issue and vehemently object to the requested hours of operation, the number of permitted outdoor patrons and modifying the design intent of the building to accomodate these requests.

EPA Guidelines (http://www.environment.nsw.gov.au/questions/times-residential-noise-restrictions) specify that noise including background music is not to occur in residential areas between the hours of 10pm to 8am on Monday-Thursday, and Midnight to 8 am on Friday, Saturday or any day preceding a public holiday.

The hours requested in DA201700483 clearly violate these restrictions, and despite limiting outdoor patronage, do not do enough to contain noise issues I feel I will face residing directly above the restaurant. Suggestions that a 'please reduce noise' sign will generate any positive outcomes are speculative only and their effectiveness cannot be accurately measured. I also take issue with the design intent of the original architects of the site being modified to accomodate for a plan that exceeds council guidelines in the first instance. I am also concerned that this application is being applied for while the directly impacted residents living above the retail space are unable to be notified.

I am concerned that late operating hours will suggest that this business will operate as more of a bar than a restaurant or cafe and will lead to extremely loud and intoxicated patrons, with extremely loud music playing, who will upset an otherwise peaceful and quite area in Dulwich Hill. There is plenty of amenity on New Canterbury Road within an easy walking distance for this kind of patron and I would suggest that anything other than a quiet cafe is extremely out of place with the character and nature of the area. The suggestion in the Statement of Environmental Effects that the New Canterbury Road precinct is too far away and therefore a late night venue in a quiet residential street is justified is absurd. I take issue with a lack of consideration for safety of residents with allowing a late night venue to operate directly below a residential building. The Light Rail service from Arlington Light Rail Stop does not currently operate past 11pm, negating the need to cater for an audience until Midnight 3 nights a week. The Statement of Environmental Effects claims that the target clientele will be local families with children, who wont be dining at a venue at 11pm and Midnight.

I am extremely disappointed to see an application like this, with little to no consideration for the hundreds of current and future residents alike who will be directly impacted by this application. I specifically wish to live in this area for the village style atmosphere and the like-minded residents who enjoy the sanctity of the area.

I respectfully request that the Council amend this application to operate within the appropriate EPA guidelines by limiting the late-night operating hours of the business to absolutely no later than 10pm. I also request that the number of patrons permitted in the outdoor dining area be limited, as currently the plan is to allow more patrons to dine outside than inside (currently 88 external and 72 internal). I also request a restriction on the service of alcohol by this business in order to preserve the quiet atmosphere of the area.

Alcohol shouldn't be permitted near where people are trying to sleep (especially when the concrete blocks will create an echoing noise chamber).

My family and I strongly object to this DA for several reasons:
- Operating hours clearly exceeds EPA guidelines. It is not conducive to the family village atmosphere of Dulwich Hill. Families will not be dining until midnight or 1am. It will attract younger customers only interested in drinking.

The restaurant will be closed for a maximum of 6 hours per night 3 days a week. This is not acceptable, especially for the area.

- A 160 seat restaurant and bar is far too large for the area - it is more like a function centre. Two or three smaller eateries or shops (operating in reasonable hours) would create more variety, interest and competition.

- Restaurants have several covers a night so a 160 seat venue could have up to 480 patrons a night. This venue is in the middle of a suburb not the inner city. How are so many people going to get in and out of the narrow streets and try to find parking (while resident parking is bad enough and restricted parking now in place? Traffic congestion and parking will be and is already a major issue.

- Allowing this to proceed will only set a precedence for more large scale operations which will destroy the village charm we all love about Dulwich Hill.

I object to the application on the following:
- this application is not in keeping with the area and the local community. A venue of this size and proposed opening hours should not be in the midst of the high density residential area, more suited to the New Canterbury and Marrickville Rds area .
- the impact on the residents living in the direct surrounding area is unable to be quantified at this time given the buildings have not been completed.
- when the future residents of this area purchased their apartments off plan they did so on the basis of the originally approved retail site and the amenity of the area. This application substantially changes that
- this residential area is inappropriate for such a large restaurant. Parking is and will become more of an issue, especially as the the Light Rail service from Arlington Light Rail Stop does not operate past 11pm

This application should be rejected and the original plans for this retail space should be retained.

Hello,

I live in the nearby Denison building and would love to see a place like this nearby. I fully support this application up and until the closing time of the nearby light rail. Should light rail hours be extended I believe the application would be appropriate. I would like to counter the previous commenters fears with the fact that the “young and rowdy drunkards” would not be attracted to an establishment such as this. I see no reason why quiet local nearby residents shouldn’t be able to enjoy a drink until 11pm.
