The Proposed dwelling is NOT consistent with the prevailing/established front setback in the street. The proposal actually steps forward closer to the front boundary on each level - as shown on the east elevation, with the third story having only a 4.5m setback (noting that the east elevation provided shows not dimensions from the boundary line). The proposals blade walls protrude beyond the front setback and effect the light and amenity to the neighboring properties as highlighted on the shadow diagram 9am 21 June.
Currently the existing open car port along the west of property 38A provides light and ventilation to the neighboring building. The elimination of the driveway and proposed solid structure so close to both the north / west corner will have great impact on property No 40 with regard to light, ventilation and privacy.
Proposed windows on the West elevation will effect the privacy of opposing property No 40 as they will be directly opposite the bedroom windows.
The proposals overall west elevation is extensive with only minimal open space between the rear of the house and the proposed granny flat. The solid structure proposed to be an alfresco area to the rear of the proposal is further obtrusive and prevents prevailing east sea breeze. Appears to not be alfresco but additional room.
The proposed bin area is located adjacent to the window of habitable room of property No 40. It is suggested the bin area is located to the eastern side of the proposal as there is a driveway providing a 2947mm clearance to any neighboring habitable room.
The Proposed dwelling does not comply with Max height in storeys for Dwelling house: (2 storey). Roof terrace exceeds the height limit and does not respond to the local context, in particular scale and pitch. The applications statement of Environmental effects references the proposed Roof terrace is similar to 9 and 9A Robinson street – However 9 and 9a Robinson Street are Zoned R3.
