Description: The application seeks the removal and/or variation of the restrictive covenant affecting 20 Bonbeach Street, Shepperton to enable the lawful occupation of an approved High Physical Support Specialist Disability Accommodation (SDA) development. The development has been completed in accordance with the approved plans and has been purpose-built to provide accommodation for NDIS participants with high physical support needs, including dedicated Onsite Overnight Assistance (OOA) accommodation. The building has been designed and constructed to meet the requirements of a Class 1B building under the National Construction Code. However, due to the restrictive covenant, the Relevant Building Surveyor has issued a Class 1A Occupancy Permit only, preventing the intended Class 1B occupancy. The proposed removal and/or variation of the covenant will not alter the approved built form, increase the intensity of development, or adversely affect the surrounding neighbourhood. It will simply enable the completed development to be occupied for its intended purpose. Removing or varying the covenant will facilitate the delivery of much-needed Specialist Disability Accommodation and allow eligible NDIS participants to access purpose-built housing that meets their support needs. Accordingly, the removal and/or variation of the restrictive covenant is considered appropriate and is supported in the interests of proper planning and the provision of essential community infrastructure.
