I completely oppose this request for planning permission to have the outside terrace open until 1am, 7 days a week. I own a property in the building and have had numerous complaints from my tenants regarding the excessive noise already coming from the nightclubs. If this were allowed, the residents in the building would have no chance of any sleep and it would certainly have a negative impact on their lives. The nightclubs/bars are already allowed to have extremely high noise levels, which are in breach of existing laws, so if it were allowed to be outside as well, then it would be much, much worse. City of Sydney needs to realise that, although we choose to live in an area that is full of "nightlife", we, as residents, or tenants, are also entitled to live peacefully in our homes.

I am a resident and owner of an apartment in the building where Cult operates. I completely and utterly oppose the extension of trading hours, in our outside common property, by nightclub operators and their fly in fly out DJ's.
There is constant unnecessary and unwarranted noise from amplified music, and in particular bass; as well as poor behaviour by patrons, on our common property and on Bayswater Rd. There are fights, turmoil and constant grief caused by this club, and other on the street. A line needs to be drawn. Enough is enough.
Residents being subjected to amplified bass til 3.30 on Sunday mornings, and public Holiday Mondays is unfair. And that is whats happening now, as the bar trade outside til that time, every night they open - with no monitoring by Council!
Although the outside area may well be licence for 42 people it generally operates well in excess of that number of patrons - and they are truly rowdy. And it may be suppoesed to close at 1pm - but it doesn't close til 3.30am. Ever!
We are confronted each morning, as often as not, to vomit in our courtyard and on the street, rubbish every where and a general feeling of dissolution caused by the excessive, prolonged, unconscionable noise made Cult and it's operators.
Police are always at the scene and have several times shut the venue down for poor operating practices. The do not deserve more time.
The trial til 1pm has been a total failure, for residents in this building, and the street. Council needs to understand we are all human. We need to be allowed time to sleep. Council is responsible for keeping the peace in the neighbourhood and we request that they do so by denying this application.

Further to my comment above (apologies for typos) I would like to ad that Cult, the nightclub in question, doesn’t serve food, in the outdoor area in question.
The idea of outdoor ‘dining’ is a farce. The club doesn’t even have a kitchen. They serve alcohol, in abundance, and maybe a few bags of chips - tho I’m not sure even sure about the chips…
Cult is certainly not a restaurant, and there is no ‘dining’ outdoors, when it trades.
The concept of this club providing ‘dining’ is a joke. They don’t. They never have. The permit to trade outside should never have been granted.
Council has allowed this venue to pretend it’s a dining area at night. It’s not. It never has been. And the whole neighbourhood knows it. So let’s not pretend, anymore.
Furthermore we request that Council ensures that the outside area is closed at the time specified by consents. Not 3.30am, as is the current practice.
CoS - do your job. Enforce consents.
There is a misunderstanding regarding trading hours and outdoor 'dining'.
1. Mentioned in CoS notification of 16 June that trading hours go til 1am, which is clearly disregarded by the licensee - who trades outdoors til 3.30am +
2. There are no 'dining' facilities (ie. tables), nor kitchen, to my knowledge.
3. The chairs outside are clearly for smokers in the club, not dining.
4. Why, when other venues in the area are clearly aware that their courtyards must be cleared by 10pm due to residential concerns, is this venue allowed to continue outdoors til 3.30am - although requesting extension til 1am.
5. There's generally more than 42 people outside.
As an add onto my previous correspondence, I object to the proposed extended trading hours of the club and eagerly await your response.
I live above the premises in question. My outdoor balcony looks directly into the said area. I concur with all my neighbours that the area subject to this DA is not - by any stretch of the imagination - a dining area. It is a continual smoking area, with over loud music. It is certainly not in the interests of the owners, residents and tenants of any of the properties either side of this block on Bayswater Rd to allow a continuation of this trial.
I further ad that the outdoor area always trades til the club closes at 3.30-4am. I have never seen any CoS officer enforce the 1am closure of the smoking, area, nor prior to this extension, the 10pm closing of the area. I therefore request Council to enforce the DA consents.
As a resident I am very familiar with what happens in that outdoor area because I , like my neighbours, get very little sleep, due to the noise, so have a constant eye on the trouble caused by that venue.
