- We are re-aligning boundaries at accord with permit TP-2019-315. The western portion of the existing boundary between CT 3129/617 and CT 6547/304 (where the party wall easements currently lie) will remain along the median of the party wall as intended on these two parent Titles. However we are modernising the boundary to a thick boundary line defined by median of wall so the boundary does in fact coincide exactly with the wall rather than having the boundary defined by dimensions where the boundary may not coincide exactly with the wall due to survey differences. As we are converting the western portion of the dividing boundary (where the party wall easements currently lie) to a thick boundary line defined by median of wall for better accuracy, LUV will not allow us to show express party wall easements along this boundary. We are therefore applying to have the party wall easements created in Instrument 422053 (attached) removed as part of this subdivision process. The these express party wall easements. These party wall easements will be replaced by 12(2) easements due to the thick boundary line along the median of wall. 12(2) easements acting as party wall easements will also be created along the other thick boundary lines on our plan where express easements did not previously exist on Title. This will provide consistent and accurate implied party wall easements over all of the walls that define boundaries on the plan
