I wish to acknowledge that this application was originally a DA which was subsequently withdrawn because it did not comply.
I am therefore confused as to why this subdivision has now been allowed to be approved under a complying Development certificate by a private certifier.
My understanding of the Complying Development Code is that there is no subjectivity. It is still required to meet minimum standards for approval.
This building remains uncompliant according to this code. Could you please provide an explanation of why it has been approved and provide advice as to what further action can be taken.
The process followed by the owner has been nothing short of devious and totally disrespectful to both neighbours and Council.
