The tree is a significant position adjacent to Swaine's Creek. I ask that Council determine if indeed the tree is beyond saving or perhaps any problem branches may be pruned. It is normal for Blackbutt to have dead limbs.
If the tree cannot be saved by remedial action, I ask Council to require the owners to replace it with another of the same species.

It is normal for dead limbs on any tree. Has the tree been examined and treated if sick in the first instance?
If after treatment and pruning the dead limbs, the tree does not improve only then the removal can be considered and if so then the tree must be replaced with the same species.
