You are only supplying 7 PARKING SPACES for 41 dwellings. You are obviously unaware of the chronic shortage of Parking in the whole of Sydney and this includes most especially Newtown. 41 dwellings should have 41 spaces.???

The solar and cross ventilation figures look dubious. Counting two windows on a single elevation (e.g. 106) seems questionable.
Solar access compliance also looks questionable given the building orientation. Particularly important on amenity given the large deep and narrow apartments. A simple perspective view from the sun at 11am and 1pm should be provided to confirm this.
Obviously there is the question of whether compliance with these is critical for the adaptive re-use of a warehouse building which is welcomed.
We are being forced out of our home that we have been living in for 18 years due to this development.
Due to the developers wanting to work on this warehouse, we have been advised that they will need to work in the property we live in and will have no choice but to leave as the warehouse wall that we share will become unsafe.
We will not be compensated and with the rental market in the state that it is in, I just hope that we can find a house to move to.
Hey Scott
Did your landlord only tell you now?
The da was over a year ago. Landlord should have given you more notice.
Local nsw rep jenny Leong might help you
Her office is in king st near the Sando
Hi Joe.
We knew of the work to be done on the warehouse but we were told by developers and landlord we wouldn’t need to move out. Developers/builders only advised a couple of weeks ago that we will need to move out.
I’ve already emailed Jenny Leong but although she was sympathetic to the situation could not really assist
Have you sought legal advice? I suggest talking asap to Marrickville Legal Centre and, if you are tenants, the Tenants Union. Also Work Health & safety. If you own your home I can’t see they can force you to move without compensation.
Also contact your local councillors and the Mayor’s office and be prepared to go to the media.
If they force you out then they should provide alternative accommodation. I would just refuse to move unless they do this.
Local journalist Wendy Bacon may be able to help.
Hi Jennifer,
We are tenants at the address and have been for the past 18 years. The landlord has advised us that it is the council who has ordered us to vacate the premises after consultation with developers/builders stating once the refurbishment commences, exterior walls will become unsafe.
From what I understand, the landlord of our place will be compensated but us as the tenants won't be.
Scott, that sounds dreadful. What happens if you refuse to go? Does the DA allow this? How about contacting the media and making a public appeal to the mayor? I would suggest contacting your Frderal MP as they are in the same party as the mayor.
This highlights a more general problem of the effects of developments on neighbours. Building work, noise and dust can make homes unliveable.
Marrickville Legal Centre at Addi Road offers two tenancy services that provide free, confidential legal information, advice and advocacy to renters living in social and private residential housing.

I think the best you can hope for is to ask for an extension as you are having to move with minimal notice.
Refusing to go will just make it more difficult. Make sure everything is in writing. You can’t change the DA but you can ask for an extention and you can use the legal help mentioned above to find support and advice.
Try all the suggestions here but it looks like you’ll have no choice but to move. The Reno project will likely be 12-18 months.
Best of luck.
Hi Scott, If you are on a Periodic (continuing) lease then the Landlord must give you 90 days written notice for termination. That is the law and is in the tenancy Act. This will at least give you 3 months to find another place.
I love that everyone is rallying around Scott, but is this really a planning matter?
Yes Max. It kind of is. Because the e council said it was ok for Scott to be forged to move in 30 days when the da was a year ago. If Scott was better informed at the time of the da, or even 3-6 months ago he’d have been able to make a better decision. So yes. The council can’t turn from “no problem” to “leave in 30 days with no support”
So. Yes.
@simon
If Scott’s lease was created 18 years ago would he still have that protection? He would be under the terms of that lease unless legislation supersedes that lease?
Might be something to raise with your legal aid?
