This Development seems to have a good ratio of Density. And the setbacks seem to adhere to the City Plan. BUT… THE HEIGHT is outside the City Plan Guidelines and must be REDUCED by at least 2 levels. This height is completely unacceptable to me, as I live across the road from this planned development and the PRIVACY AND SUNLIGHT I will lose is unacceptable.
I will be fighting this Development unless the height is reduced.

The current regulations for beachfront high rise specify 16 metres or 4 levels as I understand it.
This development is far too high and contravenes the current City Plan.
The privacy of all surrounding properties will be lost.
The shadow from this structure will ruin all the neighbours too.

That is “future intent of the area” as Cr Cameron Caldwell said when he achieved a REFUSAL for a development in HIS ELECTORATE, that WAS WITHIN THE CITY PLAN.
Where are Amendments 2&3..? Why have they not been signed off by the State Government?
Is it so Developers can keep applying to build these massive towers that are not in keeping with “the future intent of the area”..?
It’s an utter disgrace that Palm Beach is being destroyed by the Light Rail Overlay trumping the City Plan and destroying peoples lives.
It’s unacceptable. It should be no more than 16m in Height.

Yet another development drastically outside the City Plan.
9 levels is unacceptable and not within the “future intent of the area”... as Cr Caldwell stated when getting a REFUSAL for a development for his division that was actually WITHIN THE CITY PLAN.
Amendments 2&3 State the maximum height is 16m.
In today’s (26/6/21) Bulletin Mayor Tate stated “Almost two years ago, this Council actually reduced height limits along Jefferson Lane (by 50 percent lower).”
So, is Tom telling the truth ....? If so, THIS DEVELOPMENT MUST BE REJECTED AND ITS HEIGHT MUST BE CAPPED AT 16m.
As a Neighbour to this Development, I will strongly object to this Development and will not stop until the height is capped as per Amendments 2&3.

More than 16 mtrs high but also one bedroom per 50 sq mtrs of the land as well so that could make it be lower height limit if land size is not there.

Why is the current city plan not being adhered to? Given this proposal it makes a farce of the development approval process. Didn’t the amendments 2&3 state that the maximum height is 16 metres? Does this proposal of 9 (yes nine ) levels not breach that ? Didn’t the current mayor state in the Bulletin recently that the Council actually reduced the height of developments by 50 % in Jefferson Lane a few years back…or has this somehow been changed again? Against the will of the voting ratepaying constituents of the area? What impact on the residents of the density, shadowing from the height of this proposal and privacy of the neighbouring residents was taken into account when this application was made ?

A week or so ago I heard Tom Tate say on the 'abc radio' (I think Nicole Dyer was the presenter) that people who purchased property in 1984 in Palm Beach, ie Jefferson Lane, could still build at the level of restriction posed on them then. He said the level then was higher than the level today. He did not go into specifics of what the levels were then and are now. Surely all these new developments are not being developed by the original property owners of the early 80's?

I agree with the comments raised above. I believed that at the end of 2019 the GC councillors unanimously agreed (under committee chairman Cameron Caldwell) that, along the eastern side of Jefferson Lane, the maximum height of future developments will be 16 metres with a density of one bedroom per 50 square metres, changing the zoned land from medium density to low-medium density. Given that these were the recommendations approximately 18 months ago I am very confused why GC Council would consider the current development application MCU/2021/278 for 13 three & four bedroom apartments over 9 levels reaching a height of 29metres at 39 - 41 Jefferson Lane i.e. the eastern side of Jefferson Lane. This makes no sense to me at all and I sincerely hope that the GC Council will reject the proposal in it's current form.

This news is very alarming. We purchased in Palm Beach on the advice that building height restrictions on our end of Jefferson Lane had been reduced to 16 m or 4 levels. What happened with the GCCC’s commitment and amendment approval process?

I purchased in this area with the information confirmed that the height levels were to be 16mtrs and that NO developer
-under the old rules of allowable higher heights had any DA's in place- so there fore we were to be a lot more protected with our views and the shadows on our new place of living for the future.

Secondly - ON top of this we were told that also the land size had something to do with heights of future developements as well which also made purchasing reassuring.

With only 1 bedroom per 50 sq mtrs of land is what would be approved
so there fore it would restrict the 16mtr height rule to be even lower as many of these beach front blocks were quite small.
I do not approve of this change of usage request and would really hope that the council is going to keep to it's word and obide by the rules they advertised to be in place- as our balcony will have full shade in winter - ALL day, by their shadow sketches on this application, and this is not acceptable either.
At the moment we have the winter sun until 1pm each day of full sunshine and this will be taken away if this building height is approved and become NIL.

For the better use of a huge amount of community and not just me that I beg that the council sticks to the rules they put in place long before we all moved to the area, under those past promises. We did our due diligence on the rules advertised to make the decision to move to this area and expect them not to be changed.

I also moved to Palm Beach after being assured there was a cap on height levels of future developments. The proposed development height at 29 meters is against the intent of the City Plan of 16 meters.
Road Safety would be severely compromised given the close proximity to the 3rd ave beach access.
On these 2 points alone, the GCCC would be remiss in approving this current application.

What happened with the GCCC’s commitment and amendment approval process you ask?
Is it an amendment that has been passed in Council? or a proposed amendment to pacify members of the general public into thinking it is 16m but the process remain incomplete to allow developers to propose building at the current 29m?

All buildings along Jefferson Lane need to be prevented from building that oppressive height of 29m. There are a few that are high along the beach front and that is enough!

The height of this development will destroy not only property values but the quality of life for residents along Jefferson Lane. The shadow cast by the size of this building alone must deny any consideration of such a development. This will kill peoples backyards in winter and deny them the cooling afternoon breeze in summer.

Parking is already a challenge along Jefferson Lane for residents. The car parking is not enough for what will be summer holiday rentals cramming our streets. The danger to the public of these extra cars to walkers, children and cyclists needs to be considered.

During developments will residents lose beach access? This will be unacceptable to all residents.

What ever happened to the height limits of 16m? Can we trust this council to ever keep its word? I did not move to Palm Beach to live in a concrete jungle.

This area is rapidly becoming too crowded - and too high,
There is no need for anything to be above 3 stories on our beautiful beachside
Residences - and nine stories is above the City Plan limits -
so please adhere to this and there seems to be a lack of landscaping around new buildings and space between each block.
Please check that the plans for this new application couldn’t be more suitable,
and keep our glorious Palm Beach suburb calm and beautiful.
We must stop sometime - NOW would be a good idea.

I have opposed this application, for many reasons- how it is opposite what was the intent for this area, also the height, and how close it is to boundaries, and then parking - together with a big question -
what will happen during construction?,
how will they not make the road more dangerous than it is now?,
with the development close to a narrow bend, and near another corner, and beside a very popular busy walkway to the Beach together with the Lane being very busy for push bike users as well, and with the fact there is no spare parking already-
where will all these tradies park easily to get their gear to the jobsite?,
and how will they get deliveries delivered safely with out causing extra hazards in the area?
I have written a few times on this site, and also I have written personally to local councilors, and would like to hear when this will be discussed at council meetings and if there is some chance of the council listening to our constructive comments and I would appreciate some information on this time line and really hope the Council protect the area and keeps to their original intent usage for this end of the coast- Thankyou

I have read all the above comments and am at a loss to understand how the GC City Council could approve the building of a nine storey apartment building when it quite clearly contravenes what was a unanimous decision by the GC City Council at the end of 2019. I along with many others bought my property on the understanding that the 16m height was in place for all developments on the eastern side of Jefferson Lane.

On further investigation I have read that Cr Cameron Caldwell was successful in achieving a refusal for a development in his own electorate (that was within the City plan). I’d like to know why this proposed development is being considered in it’s current form when it does not meet the current City Plan.

If this development goes ahead it will be open slather for other developments to go ahead in Palm Beach affecting multi million dollar homes and apartments. Not to mention loss of privacy, shadows on the beautiful beach, no parking at all and the list goes on. People move to this area for a reason, if they wanted to live in Surfers Paradise or Broadbeach they would. Palm Beach will be ruined.

Please honour the intent of the City plan (amendments 2 & 3) and reduce the height of 39 Jefferson Lane to comply with the 16m maximum height. It is also time for the 16m maximum height to be enacted so that Palm Beach residents can believe the GC City Council has the beauty of Palm Beach preserved and it’s residents confident that they are being heard.
