Dear Councillors and Council staff,

I am writing to you to lodge an objection to Development Application DA-483/2018/F. Looking at my objection, please take into account the material planning considerations of noise and disturbance resulting from using any commercial terrace in a residential area until 10:00pm.

The Statement of Environmental Effects - 163 Birrell Street WAVERLEY - McCarthy_PAN-106509 proposes on page 9
“to align the hours of operation of the terrace (currently 7:00am – 9:00pm) with the approved indoor hours of operation of the bowling club (7:00am – 10:00pm). The terrace will only be permitted to operate between 9:00pm and 10:00pm if the proposed bifold doors are fully closed (and thus operating as part of the indoor club space).”

However, this is misleading and wrong since page 8 of that document states “The northern part of the terrace facing Birrell Street will continue to be an open unenclosed area.”

Therefore, approval of the Development Application would increase the risk of noise and disturbance complaints due to the use of the terrace until 10pm.

Given this, conditions surrounding the operational hours should be placed on the bowling club instead of the terrace. In other words, there should be a requirement for club both the terrace and the club to operate 7:00am – 9:00pm to comply with inaudibility criteria.
