I am a bit concerned to see that all of the trees are being removed. The health in particular of Tree 1 is very suspicious. From a quick look on google street view I can see that the tree looks like it is in perfect health and as green as ever (no change from 2008-2020). I feel like this should be investigated as people don't just drill holes in all of the trees on a site for no reason.

Given that virtually every tree on the property os 'suspected' of having been drilled and poisoned, there appears to bea case for cessation of development in order for charges to be laid.
Bayside Council has apparently issued penalty infringement notices to the owner of the property in the order of $3,000 per tree. According to the Mayors office, 6 trees were involved. Given the scale of the tree destruction on this site, (Significant trees were involved), in addition to the payment of the fines, and public notification of the offence, there should also be a requirement that no DA should be approved until replacement trees (not shrubs, and at least of the same number killed, and of the same or similar species) have been established and are flourishing on the site, and are adequately protected from any approved subsequent development - with an additional, significantly sized financial bond applying to each replacement tree to ensure this.
I'm appalled that Bayside Council isn't doing more for tree protection esp regarding this property. To poison & kill healthy, mature trees that provide home to animals & birds and shade, improve the environment and are impossible to replace is a very serious crime. Why aren't the older properties which have beautiful, mature, significant trees monitored more closely by Council when they are sold? It's not hard to track as it's all online. A $3000.00 fine per tree is chicken feed to construction companies & cashed up owners.
I hope this case is going to court as tree protection is dealt with more seriously by a judge.
Just as an example, Kogarah Council imposed heftier fines for deliberate tree destruction.
'More recently, Kogarah Council demonstrated that it is serious about the protection of trees after a property owner received a fine of more than $40,000 for the unlawful removal of five mature trees, and lopping a further two trees without the Council’s consent. This marked the Council’s second successful prosecution for illegal tree removal, following an earlier fine of more than $30,000 in August 2012.'
As well as stronger fines imposed the same type of trees definitely need to be replaced before a DA is approved and show the land owner he cannot get away with this crime.
Has there been any further progress with action against parties in relation to the drilling and poisoning of trees on this block? Have they been able to escape penalties? Surely a property design and development proposal should have clearly shown the retention of the old growth trees on this block. Can the planning authority please provide an update as this may serve as a reminder for others to not consider cations of this kind. I am considering purchase in the same street.
