I refer to the above documentation in addition to DA/466/2015/A
It appears the developers have had total disregard for the planning and development process.
I am totally against the changing of the original stamped DA plans which:
1. Position the south propertys detention tank along the Glenavy Street boundary.
2. Indicate keeping the tree as identified in the Wentworth Avenue setback.
I find it abhorrent that the development was granted occupation certificates prior to having these matters addressed.
Prior to development the property had many large mature trees which were a haven for native fauna to live, feed and breed. The DA permitted removal of all but one of these trees which I believe was too many but I accept the councils decision on that and the developers should have been very grateful with that decision also.
Rather, they decided upon their own volition to remove all the mature trees from site with absolute disregard for the councils decision and the environmental impact.
Further, there appears to have been no need to change the location originally proposed for the detention tank and had it been placed where it was planned, the existing tree would have surely remained. A significant amount of water seems not to be captured on the property during rain events and makes its way across the street. There may be a fault in its construction which needs to be addressed to allow for slow release into the stormwater.
On another note, I believe the front fence on Glenavy Street encroaches past the boundary line - both with the rendered masonry construction and the attached light fittings. There may also be non compliance with the design of the fence.
At a minimum, I request that:
1. At least 3 semi mature native trees be planted as a replacement for the tree illegally felled.
2. The detention pit be repositioned to its original location and inspected both during and after completion by a certified storm water engineer for its effective use.
3. Replace/remove the fence on the Glenavy Street frontage to comply with it being inside or on the boundary line, and check the Wentworth Avenue fence for any anomalies.
4. Check that the development meets the minimum requirement percentage for soft soil drainage.
5. Keep me informed on the progress of this retrospective application.
