Hereby object to the intended planning of the above address, to remove the covenant, on the grounds that this application directly contravenes the purpose of the properties purchased in the area.
Should this application be granted, it would impact me directly in the following ways:
• It does not respect, significantly changes and not retaining the intended neighbourhood characteristics to the surrounding area of single dwelling houses per lot. This area of Reservoir is a quiet suburb, not intended to be filled with high density living.
• Setting a precedent for future multi-dwelling developments, which is not the intended use for land in this area.
• It was significant, historically at the time when the lots were planned, to providing individual single dwellings on a property to have enough room for proper gardens for children to play or open space living. The gardens for properties in this area are significant to remain as large individual spaces. With the dissipation of this happening in the area then the loss of the heritage significance to the area will be greatly detrimental.
• The property will most likely request removal of trees on the property or on the nature strip.
• The creation of future major congestion in the surrounding area, not only during construction, but ongoing, most likely the increase of vehicles using the surrounding areas as additional parking.
• There is the likelihood that in the future the extra cars in the area will cause heavy overcrowding parking and less parking for the residents in nearby streets in the area. Also when there are more vehicles parked on the streets there have been significant amount of times when the garbage bins have not been collected due to access and over-parking on the street. Residents are inconvenienced as they have to wait another week for their rubbish to be collected and the excessive smell affect the neighbourhood.
• Extra homes in the area will significantly impact on the Council infrastructure requirements, increase costs in maintaining rubbish collection, road maintenance and other amenities. This will then cause an ongoing effect of increase in council rates and as I am only receiving pension benefits this will be detrimental in me being able to meet the financial living costs if rates increase for me because of the extra costs the multiple dwellings are causing in the Darebin Council Area.
• Significant effect the proposal has on the environment, affecting the natural habitation of the native fauna in the area by continuing loss of trees and vegetation due to the land cleared to erecting multi-dwelling developments. If there is a continual removal of their natural territory this will significantly impact their lives and the ecological balance in the area.
• Significant social effect and multiple dwellings contributing to deteriorating the urban fabric of Reservoir. These multiple dwellings bring in renters who do not take care of the home and neighbourhood belief and have become bad influences into the neighbourhood.
• At properties that have already allowed multiple dwellings it is noticed consistently that these properties are not well maintained as it is obvious the residents do not know who is to keep the front nature strip mowed and clean.
• Significant economic effect and impact to the infrastructures in the areas for example the education institutions. The local primary school was contacted in September 2018 and spoken to the Student intake coordinator. It was indicated that the school has currently 250 students and their maximum is 270 with no building infrastructure to increase this number. If multiple dwellings are erected continuously on every block in the area, and there is an increase in young families living in the area, then the local educational facilities will not be able to cater for the substantial increase in the number of young children who may move into the neighbour in the future. Two schools in the past were removed and the land no longer available as they were sold and erected with single dwellings on the lots. There is no land for further schools in the area.
• If the continuing erection of Double storey multi-dwellings occur in the neighbourhood it will set a precedent and then significance and impact of double storey height multi-dwelling developments will over-shadow and over-look all nearby existing properties, not letting in any natural light occur and close to the boarder, residents will lose their privacy and tranquillity as they have people looking down into the neighbour’s backyard. Properties must adhered to single-level single-dwellings erected on properties to stick to privacy rights and distance from fence lines.
• Significant loss of value if the properties in the area contain multiple dwellings. It is then less likely future buyers would want to live near next door to multiple neighbours, especially if that property has a covenant on the land that restricts the building of multiple dwellings. The main reason current residents and future family buyers have move into this area is because of the restrictive covenants, wanting only single dwellings next door. If the continuing occurrence of multiple dwellings in the area keep happening, then the value of my property will greatly diminish.
• Again most residents have purchased into this area because of having a garden space where children are able to play safely and learn the cultural value and significance of owning and maintaining a garden that can help towards have fresh fruit and vegetables grown in their own backyard.
• Reservoir is about living in a sustainable living environment and if you keep changing the fabric of what historical Reservoir was created for then those that remain will have their lifestyle effected by the ridiculous amount of over development happening in what once was a very quiet neighbourhood.
It has become more and more common for developers to take the removal of covenant to properties to the Supreme Court.
I do not have the funds to acquire a solicitor every time a property developer wants to remove covenants in the Supreme Court, or develop multiple dwellings on the lots in my neighbourhood. Not only do not have the funds to have a solicitor for myself there is the possibility, if court cases are lost, that the other party will seek I pay for their solicitor fees. Please help out the existing Reservoir residents who want the suburbs to remain quiet and single dwelling houses, who do not have the funds to continuingly object to these developments in Court every single time, to stop development of properties in the area and turning them into a high density living area.
I would like to be informed, if this property comes before the Planning Committee Meeting to be in attendance so that I can express my objection and views personally.
