    First floor of new building site has been changed unlawfully from 12 m (original planning permit to 7.7 m which is non-compliant with the original permit (TP 2013-435). My balcony at 494 Queensberry Street has been lost the 80% natural sunlight.
    The subject site is under the restriction of Heritage Overlay Schedule 3, the roof of top not allow visible from ground in reasonable distance.
    The application for amend original permit should be access able by public before the change allow to go ahead. Under s 70 (1) (b) Victoria Balding Regulation an Amendment of permit or approval is subject to satisfy the public interest. ‘ (b) in any other case, if the amendment is necessary in the public interest.’ I am an owner of 494 Queensberry Street which is now suffered with a failing the natural night as a party who the owner of new building site owe a duty of care whether it is reasonable foreseeable damage under the proximity principle.
    I request the full accessible to the proposed amendment via email within seven working days. The acknowledgement of this objection regarding the amendment.
    The completion certificate has not been issued but the building has been occupied three weeks ago. The building display sing has been withdraw from site three weeks ago.
