APPEAL TO THE LAND & ENVIRONMENT COURT S4.55 (8) Modification lodged directly with the Land and Environment Court to amend the existing consent for the construction of an 9 storey mixed-use building with ground floor retail, residential apartments and car parking over 3 basement levels. The modification was previously notified to surrounding properties between 22 August 2018 and 6 September 2018 as it involved relocating approved bicycle parking spaces from within basement levels, changes to the approved building facade, including to the awning at Elizabeth Street and the insertion of 2 x new windows on the eastern elevation for apartments numbered 5.07 and 6.07.The application is now being re-notified to surrounding properties. This is because the applicant now wishes to include an over-excavation of the lower basement (basement level 3) in the application to the Land and Environment Court. The applicant has advised that basement level 3 was over-excavated by a margin of 590-795mm
