I object to the removal of any covenant and believe this application should be denied. Everyone that has bought a property on Eucalypt Drive were well aware of the covenants and if they want something different they should move elsewhere. Many of us bought our properties because we felt protected by the covenants.

I hereby state our objection to the approval of works at 61-63 Eucalypt Drive Lilydale, in addition object to removal of Covenant for the below reasons.
We have been an owner occupier for 25 years, our initial reasons for deciding to move to Lilydale Lakes was due to the nature of the enforced covenant in the belief that a certain standard be adhered to, protecting our investment as well maintaining the aesthetics that encouraged us to move to Lilydale Lakes, to date this has been upheld, our expectation is that the covenant be preserved, we believe this is paramount.
An additional story to the above referenced property will-
    • May impact available sunlight
    • Reduce the level of privacy
    • Reduce level of views
    • Not in character with other properties, both adjoining, surrounding and street landscape
Additionally removing the Covenant will remove any protection we have in maintaining our current level of views with the possibility of de-valuing our property.
We reiterate the importance of maintaining the covenant as well as our expectation of the Yarra Ranges Shire to ensure that the covenant is preserved to maintain the character, landscape and life style we have enjoyed and wish to continue to enjoy uninhibited by other residents desires to challenge what has been set in place for very good reasons.

Dear Yarra Ranges Shire Council. I write to you outraged by the application to make changes to the important covenants that cover our Lakeview Estate. We have lived here since 1998 and have excellent views over the lake. We purchased it in the knowledge that our lake view would be an asset not under threat for many decades. The application you are considering would set a horrible precedent and lower the value of every house in this estate. Please do not allow such a modification or ammendment.

Like so many others we built in thus estate not only for the beautiful nature and peacefulness but because we knew we would not get a Two storey house blocking our view . Our beautiful estate is not made to have our views blocked out by two stories high . We live with nature all around us and not have someone’s privacy invaded is not ok . I highly object to this building taking place .

I object to the removal of any covenant and believe this application should be denied. My wife and I purchased the property on Lakeview Drive in 1993 and we were well aware of the covenants in the area.
I strongly object to the removal of the covenants currently in place as they will have an affect on the current landscape and lifestyle we currently enjoy in this estate

We recently by 2 years moved into Verina Way with a clear understanding of the covenants in place for Lakeside Estate.

We waited a long time to move into the estate. Not only for the right house that suited our family but because of the landscape and beauty of this estate. The typical stereotype for an estate is living upon each other with no space and reduced privacy. This estate offers the complete opposite and this is clearly obvious when you drive through.

    Dear Yarra Ranges Shire Council.

I would like to share my concern and object to the following changes submitted in this application based on the important covenants that cover our Lakeview Estate. I have lived in this estate with my family for over 26 years with one main attraction being these rules in place and our estate for many decades not under threat for such developments. Many of us also live in the area for the following reason. The new development of the Kinley estate behind us has already had many overwhelming impacts as it is such as noise, roadworks, impacts of the environment, potential traffic lights on hull road therefore approving such an application on top I believe would be a very poor decision and would lower the value of every house in this estate. Please do not allow such a modification or ammendment.

We have no objection to the planning permit. The proposed plans in no way shape or form will impact us or others in either view or privacy and we fully support this project. The removal of the covenant for this property does not and will not affect others as the house is setback and is also not visible from the street.
