Approval for this application is also required by the NSW Office of Water.

    I have real concerns about this development. The most pressing is the impact on parking & traffic long term. That's already going to be much more of an issue when the huge development at 481-499 Malabar Road is complete - which doesn't have enough parking to cater for residents, staff and visitors.
    I acknowledge that there is parking included in the 486 Malabar Road plans, but there is always more needed than provided in a residential building.
    With 2 schools, not enough street parking now & significant traffic issues in the warmer months due to our proximity to the beach, this will compound the negative effects our neighbourhood expects to see from the 481-499 Malabar Road development.
    I am not anti-development, but we have all seen communities who have been decimated by developers not looking beyond their own block. Please consider restricting this development to the existing number of units rather than allowing for the 9 they are requesting.

    This increase from 4 units to 9 units in this development will compound the existing parking issue surrounding the area. Even with underground parking, this development does not factor in units with more than 1 car or the increased parking and traffic from their guests.
    The retirement village development at 481-499 Malabar Road already has inadequate parking solutions which will dramatically increase the parking and traffic on the street - allowing this 486 Malabar Road development in it's current state will only make things worse for all local residents. Please consider limiting this development to 4-6 units with the same underground parking solutions they currently have to mitigate this.

    Its interesting that the developer uses this argument of non compliance for exceeding height limit of 12m:
    4. The development standard has been ‘virtually abandoned or destroyed’ by
    the Councils own actions in granting consents departing from the standard
    and hence compliance with the standard is unnecessary and unreasonable;
    Hence: by developers continually applying and being granted variations to the consent authority the council is making its own LEP "unnecessary "
    By giving one developer exemption council is virtually granting exemptions to all You may ask your local council representative; Anthony Andrews, Ted Seng or Dylan Parker, why council have imposed height limits on new developments at all!
