    I originally lodged an objection to Botany Dental Surgery at 1202 Botany Road, Botany on the grounds the on-site staff and patients parking was not sufficient to support three consulting/treatment rooms and the impact the overflow would have on local residents parking. I acknowledge under the new application the reduced consulting/treatment rooms requires only 6 car spaces to be provided for staff and patients.

    The request to split the original DA into staged Construction Certificate (CC) and interim Occupation Certificate (OC) lacks considerable amount of forward planning or commitment on behalf of the applicant, the applicants now intends to pass said impacts to local residents due to the fact the applicant has commenced operations at the site prior to obtaining approval.
    • The requirement to stage the DA due to the termination of the lease at the current dental surgery premises is questionable, if taking this statement literally it indicates the applicant ignored councils notice back on 6th November 2018 to demolish the building at 1445 Botany Rd, Bayside Botany [Council (Botany Bay), reference 10.2018.1201.1.] The statement also indicates a long term tenant had zero relationship with their landlord or the landlords management agent to be kept informed of their lease termination date this is laughable.
    • To indicated the business has been impacted by COVID-19 restrictions does have some merit, however the report doesn’t indicate the level of impact as a % of turnover, the level of government assistances received, if any , the length of time the business doors were closed or did they continue to operate at a reduce captivity during the CONVID-19 period
    • The Stage 1 Interim OC dated is not supplied, so residents have no idea on starting or completion dates of each stage.
    • With no Stage 1 OC supplied, when is the start of the 9 months delay period?
    • On investigating to acquire a car stacker the purchase cost is not a considerable capital outlay. What is concerning here is there is no current commitment from the applicant to actual purchase the car stacker. With a worst case scenario indicated by the applicant as a lead time for delivery up to 30 weeks (7 months) due to the delays and the backlog in the factory in China, the applicant should have already placed their order for said car stacker to be compliant to their two stage CC and final OC as the applicant is already in operating from said site.
    • Residents are seeking confirmation that only two consulting/treatment rooms will be operational and not the three consulting/treatment rooms as per the original DA. If the applicants intends to open the third consulting/treatment room they must prepare a new DA to address the additional three car spaces required.

    Based on the volume of unknowns council should request additional information including actual enforceable timelines, otherwise the application should be rejected due to lack of transparency surrounding the finally OC
