    We object to the transfer of this licence. Our property (103 Kerr St) is very close to the back of the property that used to be Joes Garage. When Joes Garage extended their operation to the back fence in March 2008 they promised the neighbours they would do the following:
    - the modification of the existing fence along the walkway at the rear of the existing restaurant to be treated acoustically;
    - construction of a new 3m high acoustic fence within the courtyard area;
    - construction of a walkway cover (also acoustically treated) that would extend along the length of the walkway to the courtyard, wrapping around from the existing fence to meet with the new 3m high acoustic wall; and
    - the construction of the above to ensure no gaps between the walkway cover, existing acoustically treated corrugated iron fence and the new 3m high wall.

    Much of this work was never done. Therefore the transfer of the licence should be done only on condition of the original Joes Garage compliance agreement. I can supply all correspondence from this time

    The issue of the night time economy impacting on adjacent residents is of major concern to the FRA. The use of backyards increasingly for the extension of bars into the early morning hours is a matter that the council needs to address. I agree that the measures agreed to need to be enforced.

    I refer to your objection sent via planning alerts. I am unable to accept the objection as the Liquor Control Reform Act 1998 only allows objections to be made in relation to new, variation or relocation applications.
