    Dear Council,

    I am the owner of no 42 Liverpool Street Rose Bay which is to the West of the subject premises and lower down and overlooked by the subject premises.
    The development at no 46 was the subject of a long and intensive process which included objections from those neighbours (including myself) who were worried that the large double dwelling as proposed and subsequently built would overlook our properties and reduce our amenity due to overshadowing and loss of privacy.
    The wall the subject of this application was specifically included in the conditions of consent for the approval to best protect the privacy of those neighbouring properties to the west and north west of the subject premises to avoid being overlooked by the residents of no 46 and their invitees.
    As the wall was built, not complying with the approval consent I can clearly stand in my backyard and wave to the occupants of both units 1 and 2 46 Liverpool Street should I so choose and i am conscious of being overlooked by both residences.
    I object to the application and ask that council enforce the conditions of consent of the original approval and insist that the western boundary wall be constructed to its full required height and consistency as per the original approval. Also the hedge planting along the western side is not of the same consistency and longevity as a masonry wall of the required height. A hedge can die, it can be trimmed low or incorrectly resulting in a thin privacy screen if at all. A wall once built correctly and to the consent conditions is there and best protects the neighbours' privacy.
    I can only wonder at a system of certification that would certify a building as complete when a major part of the consent conditions has not been adhered to.
